On 28 February 2022, Melbourne Water submitted a formal request to Manningham Council for a Planning Scheme Amendment under Section 20(2) of the Planning and Environment Act 1987.
The corrective amendment request sought to remove or amend the extent of Special Building Overlay - Schedule 1 (SBO1) in the Manningham Planning Scheme, as it applied to properties in and around Hillcroft Drive, Templestowe.
Council resolved to adopt Amendment C137mann and seek authorisation from the Minister for Planning at its 26 April 2022 meeting.
Notice of the approval of Amendment C137mann appeared in the Government Gazette on 18 November 2022.
The revised SBO1 mapped area can now be viewed on the Department of Environment, Land, Water and Planning (DELWP) website.
Manningham Council is announcing the commencement of the public exhibition of a planning scheme amendment C127mann and concurrent planning permit application PLN20/0303 for land at 674 to 680 Doncaster Road, 2 Short Street and 14, 14A, 16 and 18 Hepburn Road in Doncaster.
The exhibition period will be from Thursday 10 June to Monday 12 July 2021.
The amendment request and planning permit application has been made by Hollerich Town Planning Pty Ltd on behalf of the landowner, The Properties Corporation of the Churches of Christ to facilitate the future development of the site.
The request proposes the partial demolition of the existing heritage listed church, the construction of a 17-storey mixed-use development comprising 177 dwellings, a place of assembly, child care centre, two food and drink premises, offices, a reduction in the standard car parking requirements and to alter the access arrangements to a road in a Road Zone, Category 1. Ten of the dwellings within the development are also proposed for affordable housing.
If Planning Permit Application PLN20/0303 is approved, a Section 173 Agreement will secure the provision of ten affordable housing dwellings within the development. Manningham Council will welcome submissions from any person who may be affected by Amendment C127mann, Planning Permit Application PLN20/0303, or the draft Section 173 Agreement.
Manningham Mayor, Cr Andrew Conlon said that consultation on planning within Manningham is crucial to understand what our community cares about.
“Good community engagement is helping people have a say on any Council decision that impacts them. Please make a submission on this planning scheme amendment or permit for a mixed use building if you have anything you’d like to contribute.”

The Planning Scheme guides the use, development, and protection of land in Manningham. It includes written policies, as well as maps showing where zones and overlays apply across the municipality.
The Scheme is made up of many planning policies and controls that are set by the State Government. This review seeks to identify changes to the planning scheme associated with the provisions that we are able to influence.

Changes to the Manningham Planning Scheme, which would enable an expansion of Westfield Doncaster, are proposed to go on public exhibition during July and August this year, subject to the Minister for Planning granting authorisation.
Known as Amendment C104, the proposed change will revise and introduce new planning controls to the Westfield Doncaster site at 619 Doncaster Road, so that Manningham Council can consider the expansion of retail and commercial floor space.
Council resolved to support the exhibition of the amendment concurrently with a proposed Development Plan at its 31 May Council meeting following a request by Contour Consultants on behalf of Scentre Group in November 2015.
The six week public exhibition period will provide an opportunity for the community to make submissions on the proposal, including a Development Plan that has been prepared for the centre.

Following on from recommendations by the Independent Panel and Advisory Committee, Manningham Council has adopted Amendment C101 to the Manningham Planning Scheme.
This now awaits the approval of the Minister for Planning, the Hon. Matthew Guy, to enable the Eastern Golf Course site to be redeveloped.
Consulting firm Urbis requested the planning control changes on behalf of Mirvac in January 2013.
A proposed Development Plan was also submitted to show how the entire site would be developed.
Following on from the public submission period, Council requested the Minister for Planning appoint a joint Independent Panel and Advisory Committee (PAC) to consider the submissions received in relation to the Amendment and proposed Development Plan.
The PAC report recommended that with some minor changes, Amendment C101 is appropriate and reflects the importance of the site to accommodate new residential development.
Mirvac is proposing that the site be developed with between 790 and 1005 different types of homes, with just over 20 per cent of the site set aside for public open space.
The Development Plan retains significant native vegetation and provides for the protection of ‘Tullamore’, the stables and three heritage trees.
Manningham Mayor Cr Jim Grivokostopoulos said the Development Plan for the Eastern Golf Course also provides pedestrian and cycling paths as well as urban design qualities.
“Manningham Council recognises the significance of the Eastern Golf Course to the City and has been working hard to ensure the right balance between development and the community.”
“The proposed Development Plan incorporates features that promote energy efficiency, water conservation and improved storm water quality,” Cr Grivokostopoulos said.

At its meeting last week, Manningham Council has outlined its submission on the Victorian Government’s draft Bulleen Precinct Land use Framework Plan and proposed planning scheme amendment aimed at redeveloping part of the Yarra Valley Country Club in Bulleen.
Council’s submission includes general support for the framework and a recommendation not to proceed with the proposed planning scheme amendment in its current form. The objective of the land use framework aligns well with Council’s aspirations for protection of the Yarra River corridor and enhancement of open space, more recreation spaces and universal access for the public to this key environmental corridor in Metropolitan Melbourne.
The submission was made to the Yarra River – Bulleen Precinct Advisory Committee, which was appointed by the Minister for Planning to advise on the framework and proposed planning scheme Amendment C125, when it convened from 18 January to 1 March 2021.
Council’s submission was informed and presented in line with its presentations to the committee hearing for the North East Link Project, which will have significant impact on the Bulleen area.
Manningham Mayor, Cr Andrew Conlon, said Council’s submission to the committee outlined the potential impacts and options for land use in the Bulleen area.
“While we support the intention of the proposed Bulleen Precinct Land Use Framework, we have concerns over the proposed planning scheme amendment to redevelop part of the Yarra Valley Country Club in Bulleen.
Amendment C125 to the Manningham Planning Scheme proposed to redevelop part of the Yarra Valley Country Club at 9 to 15 Templestowe Road for residential purposes. It includes transferring the northern part of the site to a public authority for public open space purposes.
“We know there is community benefits in creating more open space in this area of Bulleen, however our submission raised our concerns over development in a sensitive and highly valued river valley landscape,” Cr Conlon said.
In its submission, supported expert witnesses commenting on planning, visual impact, ecology, stormwater management and traffic, Council has determined that Amendment C125 in its current form has a number of issues and recommends it does not proceed.

Manningham Council is inviting comments from the community on a proposal that would enable future development at Westfield Doncaster.

The Manningham Planning Scheme has changed to better protect properties in Wonga Park from bushfire (Amendment GC 231).
Amendment GC 231 applies a Bushfire Management Overlay (BMO) to approximately 600 properties in Wonga Park.
The BMO identifies areas of high bushfire risk, that requires a bushfire risk assessment and bushfire protection measures.
If you have an existing home on your property, then no changes are required. We recommend having a bushfire survival plan during the Fire Danger Period to keep you and your family safe.
If you are planning to build a new home, then you will need to include an assessment of the bushfire risk and consider bushfire protection measures as part of your new design.
If you have a current planning permit application then we recommend you discuss the changes with your planning officer.

Manningham Council is seeking comments from the community on the proposal to introduce a new Environmentally Sustainable Development (ESD) Policy into the Manningham Planning Scheme, known as Amendment GC42.
Manningham Council and Darebin City Council are the second group of metropolitan councils to introduce ESD Policy provisions in their planning schemes.
The introduction of an ESD Policy aims to increase sustainable outcomes for development and provide guidance in achieving environmentally sustainable development.
The policy will set out application requirements to ‘medium’ and ‘large’ planning applications and will ensure that developments achieve best practice in environmental sustainability, from the design stage through to construction and operation.
Amendment GC42 applies to all land within Manningham, except for Doncaster Hill, which has its own ESD provisions.
